The current U.S. Administrations' violations of laws (cited) regarding torture and inhumane treatment of prisoners, both charged and the multitude uncharged as "suspected" terrorist.
What part of the Law does Bush not understand?
All too often Article 3 of the Geneva Conventions is the only thing cited in opposition to Bush and associates policy of torture and degrading treatment of prisoners. From any U.S. citizens standpoint their own Constitution should set the foundation, for it and it alone is the highest law of the land, and that which makes America what it is supposed to be.
Amendment VIII
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
By any stretch of the imagination the treatment of prisoners and the "Cruel and Unusual punishments" being inflicted upon them, now well known and advocated by the current administration, the 8th Amendment is being violated to the extremes. The Constitution applies to anybody on U.S. soil, or held by U.S. authorities who are all sworn to uphold the Constitution.
The continued assertions by Bush of Executive Privileges to justify his illegal actions, which violate the very Constitution he claims such authority from, are further un-Constitutional via:
Amendment IX
The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
No Constitutional authority can thus be claimed, or asserted, should it violate other rights set forth in the Constitution and Bill of Rights.
The supreme law of the land further states:
Amendment VI
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.
One cannot possibly even debate the illegality of the denial of the 6th Amendment in the cases of prisoners being held in U.S. custody and thereby protected by U.S. laws and Constitutional Rights retained by all people subject to the rule of law as defined in the Constitution.
No jury; No meaningful attorney representing them; No trial by an impartial jury; No being informed of the nature of the charges against them (and in fact no charges in the vast majority of cases in this instance); No right to face those accusing them; No right to have witnesses in their favor; And certainly no fair and speedy trial anywhere near this picture.
Congress further has no right to compromise on these issues, nor is it obliged in any way to bow to the Presidents demands on changes to these rules of law. In fact under the separation of powers the Congress and the Courts are obliged to challenge such assertions as are being made by the Executive Branch. Only changes in the Constitution itself can do that and for such to happen those charges must be submitted to the people of all States for votation, e.g. We the People retain the exclusive rights to do that. The President, the Congress and the Courts combined do not have such power in the democracy which the U.S. claims to be and which the three branches of power are sworn to honor and respect.
And what of the rights of U.S. Citizens themselves? Or are they all "terrorist?” NSA spying upon the people; Phone & internet companies cohorsed into handing over all of the communication records (a patriotic applause to those who have refused); Banks intimidated into handing over all their clients accounts information....
Amendment IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
Any American who stands by the graves of their brave relatives and friends who died in such valid conflicts as WW II and back to the American Revolution itself should beg forgiveness for what the Current Administration, the Armed Forces and "Intelligence?" & Police Agencies are doing today. It disgraces every one of those fine Americans who fought and died for what the U.S.A. stands for and the laws upon which it is founded.
How can the American People allow this? I often hear people ask, where are the likes of Jefferson and all of the Founding Fathers, the Patriots that have stood for the principles of freedom and justice?
I say to this, have the guts to stand up and be counted, for that is the Spirit of America. Not bowing to tyrants whose very acts are those of High Treason. Have the people been cowered by the paranoia and lies spread by tyrants? Exercise your rights and rid your nation of those people who defile the offices they occupy. Impeachment is a remedy written into the Constitution and another of the rights of the people. Trial for Treason should follow that.
The Rights you do not use you soon will lose. If you are willing to give up your freedom and Rights for security you will have neither, to paraphrase the founding Fathers.
Have all Americans become cowards or tyrants lackeys, or do they truly represent what they claim to be?
